ORDER

RULE.

Mr.Pranav Dave, learned Assistant Government Pleader waives the
service of notice of rule on behalf of the respondents.

At
the request of the learned advocates appearing on behalf of the
respective parties and in the facts and circumstances of the case,
present application is taken up for final hearing today.

Present
application has been preferred by applicants – heirs and legal
representatives of the original petitioner
for restoration of the main petition being Special
Civil Application No.8065 of 1994 which came to be dismissed
for non-prosecution.

Having
heard the learned advocates appearing on behalf of the respective
parties and considering the averments made in the application, so as
to give one opportunity to the applicants to submit the case on
merits in the main Special Civil
Application, present application is allowed and the main
petition being Special Civil
Application No. 8065 of 1994 is restored to file. Rule is
made absolute to the aforesaid extent. No costs.
