Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners have been made accused in Borio P.S case no.198 of 2010
corresponding to G.R No.442 of 2010, S.T No.90 of 2011 for the offence under Sections
302, 34 of the Indian Penal Code.

It is alleged that on 28.11.2010, deceased had gone to the market and while he
was returning, he was surrounded by these petitioners and the petitioner Katan Singh @
Ketan Singh @ Katak Singh assaulted the deceased , causing injury on his neck.
Thereafter, the deceased came to one of his friend and he went to the hospital. He was
referred to other hospitals for better treatment and ultimately, the deceased died. The
deceased himself had informed his wife- informant that Katan Singh @ Ketan Singh @
Katak Singh had assaulted him by the sharp cutting weapon.

Learned counsel for the petitioners has submitted that the petitioners have been
falsely implicated in this case and has prayed for bail.

In the facts of this case, particularly in view of the fact that there is no allegation of
assault on the petitioner nos.2,3 & 4 namely Meeru Lal Singh,Yugal Hembrom and
Singrai Murmu, I am inclined to release them on bail. Accordingly, the petitioners above
named are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/-
(Rupees Ten Thousand) each, with two sureties of the like amount each to the
satisfaction of learned A.S.J, Sahibganj in Borio P.S case no.198 of 2010 corresponding
to G.R No.442 of 2010, S.T No.90 of 2011.

So far as petitioner no.1 namely Katan Singh @ Ketan Singh @ Katak Singh is
concerned, there is direct allegation against him to have assaulted the deceased, I am
not inclined to release the petitioner on bail. Accordingly, his prayer for bail is hereby
rejected.
