ORDER
1. Heard
Mr. Dhaval Vyas, learned advocate for the petitioner.
2. It
is submitted that the petitioner had made the application for
fixation of premium. However, the Government, Vide order dated 21st
August, 2008, has determined the rate of premium as prevailing on the
date of the order and not on the date of the application. It is
further submitted that before making such an order, the petitioner
has not been given an opportunity of hearing.
3. Having
regard to the submissions advanced by the learned advocate for the
petitioner, issue notice returnable on 25th
November, 2008. By way of interim relief, the date for payment of
premium stipulated under the impugned order, shall stand extended
till the final disposal of the petition.
