It is stated that the petitioner responded to the notice issued for counseling for
admission to B.T.C. Course-2004 on 11.01.2010. On the relevant date it was
found that certain documents of the petitioner were incomplete.
According to the petitioner the Principal, District Institute of Education and
Training, Dadraul, Shahjahanpur vide letter dated 18.01.2010 granted further
time to the petitioner to satisfy the requirements and the petitioner was asked
to appear again on 22.01.2010. It is stated that the petitioner has responded to
the said letter and has produced the original documents and has further
removed the deficiency pointed out earlier. However, no further action has
been taken. Hence this petition.
In the facts and circumstances of the case, I am of the considered opinion that
the matter requires enquiry by Principal, District Institute of Education and
Training (respondent no. 3), who will satisfy himself as to whether the
issuance of the letter dated 18.01.2010 is in accordance with law and as to
whether such facility has been provided to other candidates also or not and
further as to whether the petitioner has removed the deficiency noticed earlier.
In view of the aforesaid, writ petition is disposed of with liberty to the
petitioner to make a representation ventilating all his grievances before
respondent no. 3 within two weeks from today along with certified copy of
this order. On such representation being made, respondent no. 3 shall consider
and decide the same by means of a reasoned speaking order, preferably within
four weeks from the date the representation is so filed.
