affidavit filed on behalf of respondent no.

4, which is a letter sent by the Sub-

divisional Education Officer, Sadar Gaya to

the District Magistrate, Gaya dated

24.12.1986 which indicates that the school

of the petitioner Madhya Vidyalaya Punaul,

Anchal Vajirganj (Gaya) has not been taken

over by the State Government under the 1976

Act.

Counsel for the petitioners on the

other hand referring to Annexure-A, wherein

it is stated that the school has been given

recognition by an authority who was not

entitled to give recognition, refers to

Annexure-12 rejoinder to the counter

affidavit on behalf of the petitioners which

is Memo No. 1442, dated 22.3.1983 which

indicates that the Committee formed by the

State Government under sub section 2 of

Section 3 of the 1976 Act has considered the

case of the petitioners’ school and has

given due recognition.

Mr. Parthasarthy (S.C. 10) is

directed to bring on record the decision of

the Committee for taking over school within

a period of four weeks to determine the

controversies which have arisen in this case

along with the original copy of the Memo No.

1442 dated 22.3.1983 issued by the District

Superintendent of Education, Gaya. A copy

of which has also been forwarded to the

Principal of the College, Secretary of the

College as well as the Treasury Office, and

the District Superintendent of Education,

Gaya.
