Today,
in pursuance of our order dated 5.6.2008, corpus of Poonamben is
produced before this Court by Mr. B.K. Pandor, Police Inspector,
Viramgam Town Police Station and Ms. Nainaben, Woman Constable,
Viramgam Town Police Station. Learned APP Mr. Dabhi is present and
heard. Though learned Advocate Mr. V.K. Joshi for the petitioner has
filed Sick Note, but, petitioner Kiritkumar Chimanlal Shah is present
before this Court.
As
per proof placed on record at Annexure : B, which is Birth
Certificate of Poonamben, her date of birth is 30.3.1991 and still
she is minor. However, in Chamber, her wish was ascertained and she
stated that at present she is willing to go with her father ?
petitioner. Petitioner was also called and kept present and he is
willing to take the custody of corpus Poonamben and he further stated
that amicable settlement will be made with the respondents No.2 to 6.
In
view of above, custody of corpus Poonamben is entrusted to petitioner
Kiritkumar Chimanlal Shah and he has taken the custody.
In
view of above, this petition stands disposed of. Notice is
discharged.
