Learned
APP stated that the State has already preferred appeal being
Criminal Appeal No.711 of 2008 against the same judgment of acquittal
which the petitioner seeks to challenge in the Criminal Revision
Application. Under the circumstances, no useful purpose will be
served in restoring the Criminal Revision Application which came to
be dismissed for non-removal of office objections. Counsel for the
petitioner, however, submitted that the petitioner would be
requesting the Court taking up the appeal to permit the petitioner to
assist the learned APP.

In
view of the above developments, this application is dismissed.
