The petitioner who passed the High School Examination-2008 has
sought the benefit of the Savitri Bai Phule Shiksha Madad Yojana
Order notified by the communication dated 21st January, 2009
issued by the Director of Education (Madhyamik).
It is the contention of the petitioner that she satisfies all the
conditions under the said Order for grant of assistance and had also
moved an application before the Committee for grant of the benefit
but till date neither the benefit has been given and nor has she been
communicated any order rejecting the application.
Learned Standing Counsel appearing for the respondents states
that in the event the petitioner now files a representation before the
Committee constituted under the said Order enclosing therein the
application submitted by the petitioner for grant of benefit, the
same shall be examined in accordance with the Order and an
appropriate order shall be passed expeditiously.
In view of the aforesaid, this petition is disposed of with a
direction that in the event the petitioner now files a representation
before the Committee constituted under the said Order enclosing
therein the application submitted by the petitioner for grant of
benefit, the same shall be examined by the Committee in
accordance with the Order and an appropriate order shall be passed
expeditiously.
It is made clear that this Court has not adjudicated upon the merits
of the case, which shall be considered by the Committee in
accordance with law.
