In pursuance to the order dated 14.07.2010, the case has been
called out. No one appears for the petitioner.
Learned standing counsel was required to seek instructions as to
whether regularly selected candidates have replaced the
petitioners.
Learned standing counsel states that in place of record, an
information has been received from the Director, Higher
Education, U.P. Allahabad, which is as follows:-
“1. That in reply to the first query it is submitted that the petitioner
no. 1 Km. Sujata Trivedi worked as Mandey lecturer, English in
Dayanand Girls College, Kanpur from September, 1998 to
February, 1999. Km. Sujata Trivedi died in the year 1999. It is
further submitted that petitioner no. 2 Dr. Smt. Sunita Singh
worked as Mandey lecturer in Botany in the said institution from
September, 1998 to May, 2004. In July, 2004 after being regularly
selected through U.P. Higher Education Service Commission, Dr.
Smt. Sunita was placed in Christ Church College, Kanpur wherein
she joined and is continuously working.
2. That in the light of the facts stated above, reply to the second
query does not arise.”
The writ petition has thus abated so far as petitioner no. 1 is
concerned. For petitioner no. 2 the reliefs claimed have since
become infructuous.
The writ petition is accordingly dismissed.
