Case has been taken up in the revised list. Learned counsel for the opposite
parties is not present. Name of Sri S.K. Awasthi has been shown but no one
on behalf of the opposite parties has appeared.
Submission of learned counsel for the petitioners is that the opposite parties
are going to make promotion on the post of Junior Engineer from the post of
Technical Grade-II ignoring the seniority list, which has been published in the
department on 25.11.2009. Submission is that in any case, promotions are to
be made in accordance with the existing seniority list as the criteria for
promotion as contemplated under the Rules is seniority subject to rejection of
unfit. It is also submitted that promotions are going to take place very shortly.
Since the promotion process is due and submission of the learned counsel for
the petitioners that the opposite parties are willfully ignoring the seniority list,
which has been published by them, it is incumbent upon them to make
promotion in accordance with the seniority list.
In this view of the matter, the opposite parties are directed to consider the case
of promotion of various incumbents in accordance with the prevailing
seniority list in the department after following the criteria provided in the
Service Rules.
