13 28-06-2010 Learned counsel for the State has

produced an instruction from Atul Kumar Singh,

Joint Secretary General Administrative Department

Patna, Bihar informing him that respondent No. 10

Shri Krishna Singh, an executive Officer of

Samastipur Nagar Parishad does not belong to the

Bihar Administrative Service Cadre.

It appears that the Joint Secretary has

just made a technical comment on the capacity of

the said Krishna Singh. Nagar Parishad is a

statutory body constituted under the statute and

the executive officers are posted by the State

Government.

Let Mr. Atul Kumar Singh be personally

present in Court on next Monday (5.7.2010).

Put up on 5.7.2010 within first five

cases.
