Heard learned counsel for the petitioner.
The petitioner’s grievance is that the
respondent no.4 challenged his transfer order
dated 23.10.2009 before the Rajasthan Civil
Services Appellate Tribunal, Jodhpur Bench by
preferring appeal. However, instead of setting
aside the order dated 23.10.2009, the Tribunal
vide order dated 5.11.2009 directed the respondent
no.4 to submit his representation to the competent
authority within 15 days with a direction to the
competent authority to decide the same within a
period of one month from the date of order.
According to learned counsel for the
petitioner, the said representation yet has not
been decided by the competent authority and one
month’s time has already passed long back.
Since the Tribunal has permitted the

respondent no.4 to submit representation after
staying the operation of the transfer order and
according to the petitioner, the representation is
yet pending, therefore, the petitioner may also
submit his representation raising his grievance
against any cancellation of the transfer order
dated 23.10.2009 if it is affecting the petitioner
in any manner and the competent authority, if, has
not decided the representation of the respondent
no.4 by now, the competent authority may decide
the representation of the respondent no.4 after
considering the representation of the petitioner
also within a period of one month from the date of
submitting the copy of this order with
representation by the petitioner to the competent
authority.
The writ petition of the petitioner is
disposed of accordingly.
