Petition for anticipatory bail.
2. The alleged offences are under sections 323, 406, 498A
read with section 34 IPC. A crime was registered against accused
1 to 3, on a complaint filed by defacto-complainant against her
husband, his sister and his brother-in-law.
3. Learned counsel for the petitioners submitted that
though a complaint is filed as Annexure-A1, the allegations are
vague and general. The main allegations are made against 1st
accused who is the sister-in-law of the defacto-complainant. The
2nd petitioner is the 1st petitioner’s husband. Petitioners are living
far away from the place of occurrence and they have not
committed any act as alleged. Learned Public Prosecutor
submitted that he has no objection in granting anticipatory bail to
petitioners.
4. Hence, the following order is passed:-
(1) Petitioners shall surrender before the Magistrate
concerned within ten days from today and if any
bail application is filed, petitioners shall be
released on bail, on their executing a bond for
Rs. 25,000/- each with two solvent sureties
each, for the like amount, to the satisfaction of

the learned Magistrate, on the following
conditions:-
i) Petitioners shall make themselves
available for interrogation by the
Investigating Officer as and when
directed.
ii) Petitioners shall co-operate with the
investigation.
iii) Petitioners shall not intimidate or
influence any witness or tamper with
evidence or commit any offence
while on bail.
This petition is allowed.
