                             JUDGMENT

Petitioner is the respondent in A.S.No.169 of 2010 of the

court of learned Sub Judge, Irinjalakkuda. The husband of

petitioner instituted O.S.No.1088 of 2001 for a decree for recovery

of possession. It is stated, respondent herein made an attempt to

get itself impleaded in the said suit as additional defendant which

was not permitted. Later the trial court passed a decree infavour

of the husband of petitioner. He expired. In the course of

execution of the decree, respondent filed a claim petition claiming

right over the property. Claim petition was dismissed against which

respondent filed A.S.No.169 of 2010. Petitioner states that she is a

widow aged about 83 years and that attempt of respondent is

somehow prolong execution of the decree. Petitioner therefore

wants an early disposal of the appeal or the application for stay

(I.A.No.4361 of 2010). Learned counsel requested that learned Sub

Judge may be directed to dispose of the appeal as early as possible.

2. Having regard to the circumstances stated, learned Sub

Judge is directed to dispose of the appeal as early as possible.

This petition is disposed of as above.
