In this writ petition the petitioner has prayed for a direction on the respondents to issue

appointment letter to the petitioner, as he has been duly selected for the post of Para Teacher

by the Gram Sabha in its meeting held on 26.8.10 pursuant to Advertisement No. 2075 dated

5.8.10.

It has been stated that the respondents had issued advertisement in the newspaper for

selection / appointment of Para Teachers. The petitioner applied for the post of Para Teacher

(English) in Upgraded Middle School, Hitzara, Sonahatu. The Gram Sabha was held on

16.8.10 for selecting the Para Teachers and in the said Gram Sabha, the petitioner was

selected as English Para Teacher. After his selection, the same was informed to the Block

Eduction Committee for approval and for issuing appointment letter as far back as on 26.8.10,

but till date no order has been passed and appointment letter has not been issued by the

concerned respondent.

Learned J.C to S.C-II appearing on behalf of the respondents submitted that the

District Superintendent of Education-cum-District Programme Officer, Jharkhand Education

Project, Ranchi is the competent authority to consider the petitioner’s grievance and if the

petitioner files fresh representation before the said authority, the same shall be considered

and appropriate order shall be passed.

Considering the said submissions, this writ petition is disposed of giving liberty to the

petitioner to file fresh representation before the District Superintendent of Education-cum-

District Programme Officer, Jharkhand Education Project, Ranchi. On receipt of such

representation, the said respondent shall consider the same and pass appropriate oder in

accordance with law within six weeks from the date of receipt of the representation.
