Heard learned counsel for the revisionist and learned A.G.A.
Learned counsel for the revisionist submitted that the revisionist is
the recorded tenure holder of the plot in dispute and the opposite
party has no right or interest in the property in dispute.
Issue notice to opposite party no.2 for filing counter affidavit
within four weeks.
Rejoinder affidavit, if any, may be filed within a week thereafter.
List after the expiry of aforesaid period.
Till the next date of listing, the order dated 31.5.2010 passed by
S.D.M., Sahjanwa, Gorakhpur in Suit No.19 under section 145
Cr.P.C. State Vs. Lal Bahadur (first party) and Chandra Prakash
Dubey (second party) shall remain stayed provided, the land in
dispute has not already been attached.
