Heard learned counsel for the applicant, learned A.G.A. and perused the entire
record of the case.
The submission of learned counsel for the applicant is that accused applicant
is father-in-law of the deceased. He further submits that there is general
allegation that the deceased was ill-treated and, subsequently, done to death
by accused applicant and other members of the family. There is no overt-act
assigned to the accused applicant in the FIR as well as in the statements of the
witnesses recorded under Section 161 Cr.P.C. The applicant has no previous
criminal history, as averred in para 18 of the bail application.
Considering the overall aspects of the matter, I hereby provide that the
applicant be released on bail in Case Crime No.737/2009, under Sections 498-
A, 304-B, 120-B IPC and ¾ D.P. Act, P.S. Kheri, District Lakhimpur Kheri,
on his filing a personal bond and two sureties each in the like amount to the
satisfaction of the court concerned.
