The submission of the learned counsel for the petitioner is that co-
accused Lal Ji Dubey against whom as many as three cases have
been shown in the gang chart, has already been given protection
vide order dated 22.6.2010 passed by this Court in Misc. Bench
No.5954 of 2010 while one case has been shown against the
petitioner No.1 in which the arrest of the petitioner has been
stayed. Hence, the petitioner’s case stands on similar footing with
the aforesaid co-accused. Therefore, the petitioner is also entitled
for the same protection.
Issue notice to respondent No. 4 to file counter affidavit within
four weeks. Rejoinder affidavit, if any, may be filed within next
two weeks.
List thereafter along with writ Petition No. 5954 of 2010 after
expiry of the period granted for exchange of the affidavits.
Till further orders of this Court or submission of charge sheet,
whichever is earlier, the petitioners shall not be arrested in the case
Crime No. 260 of 2010, under sections 2/3(1) of U.P. Gangster
Act, Police Station Jaisinghpur, District Sultanpur, provided that
they cooperate with the investigation, which shall go on.
