The relief claimed in the present petition is for a direction upon the
respondents to permit the petitioner to appear at the C.P.M.T
Counselling 2010 as a Scheduled Tribes candidate.

It is stated that the petitioner is being treated as a candidate
belonging to the O.B.C. and not to Scheduled Tribes. Learned
counsel for the petitioner states that the petitioner has filed a
detailed representation before the Director General Medical
Education and Training, U.P. Lucknow on 15th July, 2010, but no
order has been passed on the said representation.

Learned Standing Counsel appearing for the respondents states
that the petitioner may file a copy of the said representation along
with a certified copy of this order before the Director General
Medical Education and Training, U.P. Lucknow who shall decide
the same expeditiously.

In view of the aforesaid, this petition is disposed of with a
direction to the Director General Medical Education and Training,
U.P. Lucknow to pass an appropriate order on the representation
dated 15th July, 2010 filed by the petitioner expeditiously,
preferably within a period of ten days from the date of service of
the representation with a certified copy of this order.

It is made clear that the Court has not adjudicated upon the merits
of the case which shall be examined by the Director General
Medical Education and Training, U.P., Lucknow in accordance
with law.
