6 14.09.2011 Mr. Waliur Rahman, advocate on the instruction
of Mr. Satish Kumar, learned counsel appearing on behalf
of the petitioner, submits that the impugned order is
interlocutory in nature and as such he may be permitted to
convert this revision application into an application under
Article 227 of the Constitution of India in view of the
decision in the case of Durga Devi Vs. Vijay Kumar
Poddar, reported in 2010 (2) PLJR 954. Mr. Gopal Govind
Mishra, learned counsel appearing on behalf of the opposite
parties has no objection to the prayer.
The prayer is allowed. Five weeks time is
allowed to convert this application into an application under
Article 227 of the Constitution of India failing which this
revision application shall stand rejected without further
reference to the bench.
