Heard
learned advocate Shri Gaurang Bhatt for Ms.Jyotsana Sadhu for the
petitioner.
It
appears that to challenge an interim order passed by the Trial Court
in Regular Civil Suit No.105/07 the petitioner herein has preferred
Civil Misc. Appeal No.31/08. Along with the appeal, the petitioner
has also prayed for stay pending appeal. Learned advocate for the
petitioner has stated that since May 2008, though the appeal is
pending, request for interim stay is not yet disposed of.
Under
the circumstances, it will be open for the petitioner to request the
District Court to pass appropriate order on the application for
interim stay pending appeal. If such request is made, the learned
Judge will consider the same. With these observations, the petition
is disposed of.
