Heard learned A.G.A. and perused the record.
This application has been filed with a prayer to quash the chargesheet dated
21.1.1997 in case crime no. 119-D of 1995 under section 409, 467, 468, 471,
477A, 120-B IPC, P.S. Nangal, District Bijnor pending in the court of learned
C.J.M. Bareilly.
From the perusal of the record it appears that in the present case the
chargesheet has been submitted by the I.O.. The material collected by the I.O.
prima facie disclosed the aforesaid offence. There is no illegality in
submissions of the chargesheet as well as in taking the cognizance by the
court concerned. There is no ground of quashing the chargesheet in the above
mentioned case, such prayer is refused.
Accordingly this application is dismissed.
The interim order 25.2.1997 is vacated.
Let a copy of this order be sent to learned C.J.M. Bareilly/ Sessions Judge,
Bareilly for passing the appropriate order in the above mentioned case.
