                                           JUDGMENT

Petitioner who was initially appointed as staff nurse in the Health Services

Department through Public Service Commission was subsequently appointed as

Tutor on a regular basis in the College of Nursing under the Medical Education

Department in November, 1989. Apart from Graduation in Nursing, petitioner

had also obtained masters degree in the same subject in the year 1999. After

acquisition of her post graduation, petitioner was redesignated as Senior

Lecturer. Other lecturers who did not acquire P.G qualification continued as

lecturers. Later they were given the scale of pay of Assistant Professor on

completion of 10 years physical teaching experience. Petitioner is still being

paid the salary of Senior Lecturer, though she has also completed 10 years of

physical teaching experience. I do not propose to deal with the various

contentions raised by the petitioner at this stage in view of the limited prayer

made by the learned counsel at the Bar. It is submitted that petitioner will be

satisfied if an appropriate direction is issued to Respondent No.1 to consider and

pass orders on Ext.P5 in which petitioner is stated to have highlighted her

grievances and pointed out the anomalies.

2.The learned Government Pleader submits that if Ext.P5 has been

preferred as contended by the petitioner an appropriate decision thereon will be

taken without any delay.

In the above facts and circumstances the writ petition is disposed of with a

direction to Respondent No.1 to consider and pass orders on Ext.P5 strictly on

its merit and in accordance with law as expeditiously as possible , at any rate

within 3 months from the date of receipt of copy of this judgment. Petitioner and

all others who are likely to be affected by the order that may be passed by

Respondent No.1 shall be afforded sufficient opportunity to be heard while

considering Ext.P5. The petitioner shall produce certified copy of this judgment

along with a copy of the writ petition before respondent No.1 for compliance.
