COMMON
ORAL ORDER

1. Learned
Assistant Government Pleader Ms. Maithili Mehta places on record a
communication dated 11.2.2011, issued by the Officer on Special Duty
from Industries and Mines Department, to the Commissioner, Geology
and Mining. It is intimated by this communication that, ‘letter dated
2.11.2010 stands withdrawn’.

2. Learned
advocate for the petitioner states that, as the order under challenge
dated 2.11.2010 is withdrawn, the grievance of the petitioner stands
redressed to that extent. He, however, requests that the Government
authorities be directed to consider the application of the petitioner
in accordance with law and the same be considered without keeping in
mind that the petitioner had approached this Court.

2.1. It
goes without saying that the authorities will consider the
application of the petitioner, strictly in accordance with law, on
its own merits, and will not be influenced by the fact that the
petitioner had approached this Court.

3. With
the aforesaid observations, the petitions are disposed of.

4. The
Court puts its appreciation for the efforts put in by learned
Assistant Government Pleader Ms. Maithili Mehta, in the matter.
