Heard learned counsel for the petitioners as well as

learned counsel for the state.

Petitioners are not named in the F.I.R. nor any

persons have claimed to have seen the petitioners committing

the alleged crime. Petitioners have been named in this case

only on the ground that they carry criminal antecedent.

Considering the aforesaid facts and circumstances as

well as submission of the parties, petitioners namely, Latif Mian

and Akhtar Mian, are directed to be released on bail on

furnishing bail bond of Rs 10,000/- (ten thousand) each with

Katoria (Suiya) P.S. Case No. 142 of 2007 to the satisfaction of

Chief Judicial Magistrate, Banka.
