ORDER

1. Heard
learned advocate Mr. Nirzar Desai appearing for applicant and Mr. N.
R. Mehta appearing for respondent.

2. Main
petition being Special Civil Application No.17185 of 2004 wherein
rule is issued, is remain pending. However, meanwhile learned
advocate Mr.Desai submitted that financial condition of petitioner is
not good and in some of the cases respondent corporation has
considered benefit which was extended in favour of such employee in
scheme of 1995 though they were accepted benefit under Scheme 1971 as
condition to return/refund amount which was received by such employee
as per scheme 1971.

3. If
that be so, let petitioner may approach respondent with such
application and as and when such application is received by
respondent then it is directed to respondent to consider it if
similar cases has been considered in past by respondent.

4. In
view of above, present Civil Application is disposed of by this Court
without expressing any opinion on merits.
