                         J U D G M E N T

Petitioner underwent M.Sc Nursing Course in the 3rd

respondent college. At the time of admission, the original

certificates such as Xth Certificate, Plus two Certificate,

Mark list, B.Sc Nursing Degree Certificate, R.N. Certificate

and certain other certificates were submitted. After

completing the course, petitioner requested for returning

the certificates. It is alleged that the 3rd respondent

refused the said request, even a written representation

made, was not acted upon. It is in these circumstances the

writ petition has been filed.

2. Petitioner relied on Ext.P1 judgment rendered

by this Court in W.P. (C) No.34220 of 2008 where this

very issue has been considered by this Court and the case

was disposed of with the following directions.

” In the result, writ petition is disposed of
directing the third respondent to return to the
petitioner the documents sought for by her,
namely the originals of S.S.L.C Book, Pre-

Degree Mark list, B.Sc Nursing Degree
Certificate, Certificate of Registered Nurse,
Certificate of Registered Midwife and

Experience Certificate, within two weeks, if the
petitioner submits an application in this behalf
along with the copy of the judgment and a copy
of the writ petition.

3. I heard the learned Government Pleader also.

4. From the submissions made by both sides, it

gives me an impression that the issue canvassed by the

petitioner is covered by the aforesaid judgment.

5. Therefore, the writ petition will stand disposed

of directing the 3rd respondent to return the petitioner’s

certificates deposited by her on the petitioner making an

application for the same.

Petitioner shall produce a copy of this judgment along

with a copy of the writ petition before the 3rd respondent,

for compliance.
