                            J U D G M E N T

Petitioners filed this writ petition mainly complaining

of the poor condition of the 7 Km stretch of the road between

Polytechnic College to 66th Mile near Kumily in Kollam – Theni

National Highway No.220. According to the petitioners, they

have submitted Exts.P2 to P9 representations before the

respondents, seeking immediate repair of the aforesaid

stretch of the road and complaining of inaction on the part of

the respondents, this writ petition has been filed.

2. Today, when the matter came up, Standing

Counsel appearing for the first respondent submits that the

road in question has not been entrusted to the National

Highway and that therefore, the responsibility to maintain the

road is that of the State Government.

3. In the light of the aforesaid submission made, the

first respondent or its officers cannot be directed to take any

action as sought for by the petitioners. Since the

responsibility to maintain the road is that of the State, I direct

that it will be open to the petitioners to file an appropriate

representation before the third respondent and the third

respondent is directed to take appropriate action in the

matter.

With the above direction, the writ petition is disposed of.
