Heard learned counsel for the petitioners.
It is contended by learned counsel for the
petitioners that after dismissal of suit, an appeal
was filed by the petitioners before the Addl.
Commissioner Colonisation Cum Revenue Appellate
Authority, Jaisalmer along with an application for
stay. However, due to non availability of the
Presiding Officer, the application for stay is still
pending and not decided and in the meantime, the
respondents are going to auction the land in question.
Therefore, it is prayed that the right of the
petitioners till disposal of stay application in the
appeal may be protected.
In this view of the matter, this writ
petition is disposed of with a direction to the
respondents that till decision of the petitioners’

stay application filed before the Addl. Commissioner
Colonisation Cum Revenue Appellate Authority, status
quo with regard to the land in question as it exists
today shall be maintained.
