ORDER

S.J. Mukhopadhaya, J.

1. By the Court Heard. The grievance of the petitioner is that the respondents in spite of repeated representations, preferred by the petitioner, have not reduced the load from 90 KVA to 75 KVA, though notice was given

under Clause 9(a) of HT Agreement as back as on 24th December, 1994, which resulted into submission of different bills raised by the respondents on the bases of 90 KVA load.

2. Counsel for the Board submitted that the matter will be looked into by the General Manager-cum-Chief Engineer, Area Electricity Board, Dhanbad, and, if necessary, appropriate order will be issued.

3. In the circumstances, the case is remitted to the General Manager-cum-Chief Engineer, Area Electricity Board, Dhanbad. The petitioner will file a detailed representation, enclosing therewith a copy of this order and details of application/representation, as stated to have been made, for reduction of the load. The General Manager-cum-Chief Engineer, Area Electricity Board. Dhanbad will determine the claim, if necessary, on obtaining report, preferably within three months from the date of receipt of such representation.

In the meantime, if the petitioner deposits 50% of the outstanding dues, subject to the decision, as may be taken by the General Manager-cum-Chief Engineer, Dhanbad, the respondents will restore the electrical connection, subject to the decision as is taken by the General Manager-cum-Chief Engineer, Area Electricity Board, Dhanbad.

5. The writ petition stands disposed of with the aforesaid directions.
