The petitioner is served with Ext.P1 bill. He filed Ext.P3
appeal and remitted one half of the amount also. The appeal is disposed of
by Ext.P4. Thereafter the petitioner is issued with Ext.P5 bill.
2. I heard learned counsel for the petitioner and the learned
Standing Counsel. Learned counsel for the petitioner argued that though the
period taken should have been six months, twelve months is taken.
Learned Standing Counsel points out that the minimum period to be taken is
twelve months and therefore it is correctly done. Learned counsel for the
petitioner submits that as per Ext.P4, the calculation in Ext.P5 may not be
correct.
In such circumstances, the writ petition is disposed of as
follows:
If the petitioner represents before the third respondent
regarding his complaint that Ext.P5 is issued in violation of Ext.P4 order,
the third respondent will look into it and take a decision within two weeks
from the date of receipt of such representation. Proceedings on the basis of
Ext.P5 will be kept in abeyance for a period of one month from today.
