                   JUDGMENT

Petitioner retired from the service of the

respondent on 30.11.2007. The marriage of his

daughter is fixed to be solemnized on 30.8.2009.

Petitioner has produced copies of receipts

evidencing payment of amounts for booking the

auditorium for the marriage. He is, thus, in

immediate need of funds. He was a painter in the

service of the respondent. He cannot find out

alternate ways and means for funds to conduct the

marriage of his daughter. He has to necessarily

depend for that on his retiral benefits. The

petitioner has, therefore, shown sufficient cause

for an out of turn payment of DCRG and CVP due to

him from the respondent in terms of the

directions of this Court, however to be confined

within the 10% amount in terms of the directions

WP(C)10825/09 -: 2 :-

of the Apex Court.

For the aforesaid reasons, this writ petition is

allowed directing that the death-cum-retirement

gratuity and commutation value of pension due to

the petitioner from the respondent shall be

released on or before 30.6.2009 from 10% of the

daily collections earmarked for such purpose in

terms of the directions of the Apex Court. No

costs.
