J U D G M E N T
The petitioner retired from service on 31.12.2004
on attaining the age of superannuation. This writ petition is filed
aggrieved by the non disbursement of the DCRG in full. The
grievance voiced by the petitioner is that only part payment was
made and that more than Rupees One Lakh is due. It is now
brought to my notice that while the writ petition was pending,
further payments were effected and that as on today, the entire
amount of DCRG has been disbursed, except the sum of
Rs.25,000/=, which was adjusted by the respondents towards the
house building advance availed by the petitioner. The learned
counsel for the petitioner submits that leaving open the
petitioner’s right to contest the said claim, the writ petition may
be closed as infructuous.
In the light of the submission made by the learned
counsel for the petitioner, this Writ Petition is dismissed as

infructuous, reserving liberty with the petitioner to challenge the
adjustment of the sum of Rs.25,000/= from the DCRG towards
repayment of the house building advance, in other appropriate
proceedings.
