: In this writ petition the petitioners pray for direction on the
respondents to consider their claim of promotion upgrading the
petitioners to the post of E-1 Grade with all consequential benefits w.e.f.
the date other similarly situated persons even juniors to the petitioners
have been given promotion.

It has been stated that the petitioners fulfill all the requirements of
the Coal India Limited guidelines for giving promotion to the post of E-1.
The petitioners’ name along with others were also recommended but the
respondents have given promotion to the other similarly situated persons
even juniors to them. No order has been passed regarding their
promotion and no reason has been assigned for the same. The
petitioners filed several representations and made several requests but
to no effect.

Learned counsel appearing on behalf of the respondents
submitted that the Director (Personnel), BCCL, Dhanbad is competent
authority to consider the petitioners’ claim and if the petitioners’
representation is pending or if they file a fresh representation, the said
authority shall consider the same and pass appropriate order in
accordance in law without further delay.

Considering the said submissions, this writ petition is disposed of
giving liberty to the petitioners to file a fresh representation before the
Director (Personnel), BCCL, Dhanbad. The said authority, on receipt of
the petitioners’ representation, shall consider the same and pass a
reasoned order in accordance with law within a period of six weeks from
the date of receipt of the representation.
