Dated this the 23rd day of May, 2009.
JUDGMENT
The petitioner retired from the service of the
KSRTC as a Mechanic on 31.10.2008. He seeks
release of DCRG and CVP on out of turn basis on
the ground that he needs immediate surgery in
connection with heart disease. Materials on
record show that the petitioner faces a very
serious condition and has been advised coronary
surgery after very detailed scientific
investigations for which also he has spent huge
amounts. Taking into consideration all the facts
and circumstances, it is abundantly clear that
the petitioner has demonstrated a case of
immediate need for out of turn allotment of his
retiral benefits as a special case.
For the foregoing reasons, this writ petition is
WP(C)12601/09 -: 2 :-
ordered directing that the DCRG and CVP due to
the petitioner will be released out of turn,
within one month from today.
