                           JUDGMENT

The petitioner retired as a Principal of Ramavilasam Higher

Secondary School, Chokli in Kannur District. While he was in

service, he was suspended by order dated 19.5.2004. As per

orders of this Court, he was reinstated. Subsequently, he retired

on 31.5.2007. In the meantime, disciplinary action was initiated

by the manager against him, which was challenged in W.P.(C)

No.8709/05 on the ground that the manager has no authority to

continue the disciplinary proceedings after retirement. In spite of

the above situation, the petitioner has not been paid retirement

benefits. In the above circumstances, the petitioner has filed

Ext.P5 representation before the 1st respondent. The petitioner

seeks a direction to the 1st respondent to consider and pass

appropriate orders on Ext.P5.

2. I have heard the learned Government Pleader also.

Although the 3rd respondent has been served notice, there is no

appearance. After hearing the learned Government Pleader also,

I dispose of this writ petition with a direction to the 1st

respondent to consider an pass appropriate orders on Ext.P5

as expeditiously as possible, at any rate, within three months

from the date of receipt of a copy of this judgment, after

affording an opportunity of being heard to the petitioner as

well as the 3rd respondent. The petitioner shall forward a copy

of this judgment along with a copy of the writ petition to the

1st respondent for compliance.
