03. 02.07.2010 Petitioners are languishing in jail since

14.04.2010 in a case registered under Sections 341, 324,

307, 504, 34 I.P.C.

It is submitted by learned counsel for the

petitioners that specific allegation of assault to the

informant is against Hajari Jha who gave Farsa blow

whereas the injuries of Bablu Jha is simple in nature and

there is omnibus allegation against all. There is case and

counter case between the parties. It has further been

submitted that petitioners have no criminal antecedent.

Learned counsel for the State has however not

controverted the fact that during investigation it has come

that Hajari Jha actually assaulted the informant and the

injuries of Bablu Jha is simple in nature.

Considering the aforesaid submissions, let the

petitioners namely 1. Lalan Jha 2. Madan Kumar Jha, be

released on bail on furnishing bail bond of Rs. 10,000/-(ten

thousand) each with two sureties of the like amount each to

the satisfaction of Chief Judicial Magistrate, Purnia in

connection with K.Hat(maranga) P.S. Case No. 90 of 2010.

It is made clear that petitioners’ bail bonds shall

be accepted by learned C.J.M. only when they are not

involved in any other case except the present case.
