JUDGMENT

A.C. Goyal, J.

1. The claimant-appellant has filed this appeal for enhancement against the award dated 22nd November, 1994 whereby Motor Accident Claims Tribunal, Jaipur City, Jaipur allowed a sum of Rs. 25,000/- as compensation along with interest @ 2% per annum from 17th March, 1990.

According to learned Counsel for the appellant, it was proved by medical evidence that the appellant got a number of injuries including 5% permanent disability, and the appellant was an electrician as well as contractor arid thus the award amount is quite inadequate. Learned Counsel for the Insurance Company submitted that there is no evidence to show that earning capacity of the appellant was reduced and thus amount awarded by the Tribunal is reasonable.

3. I have considered the above submissions. As per injury report Ex. 6, the claimant got four injuries. Out of these four injuries only one injury on account of fracture in clavicle bone was found grievous as per X-ray report Ex. P/7 and 5% disability was opined as per Ex. 60 certificate. These documents were proved by doctor M.K. Mathur. Learned Tribunal came to this conclusion that on account of this evidence, it is not proved that earning capacity of the claimant has been adversely affected and medical bills only of Rs. 1,100/- were produced. Learned Counsel for the appellant relied upon one judgment of this Court delivered in S.B. Civil Misc. Appeal No. 423/1995, Rambabu v. Bajrang Singh and Ors. decided on 18th November, 1998 wherein on account of permanent disability of head to the extent of 5% the total amount of compensation was enhanced to Rs. 55,796/-.

4. I have considered the submissions. In view of entire facts of the instant case, the amount of compensation deserves to be enhanced.

5. Consequently, the appeal is partly allowed. The amount of compensation is increased to Rs. 32,000/- instead of Rs. 25,000/- along with interest @ 6% per annum on the enhanced amount from 17th March, 1990.
