ORDER
RULE.
Mr. Pujari, learned AGP waives the service of rule on behalf of
respondents.
1. Heard.
The applicant, herein, was released on parole leave for a period of
FIFTEEN DAYS by this Court vide order dated 29.01.2008 for
enabling him to prefer appeal before the Hon’ble Apex Court against
his conviction. However, since, there are certain arrangements are
required to be made by the applicant for approaching the Hon’ble Apex
Court, he has preferred the present application seeking his release
on parole leave for a period of sixty days.
2. In
view of the fact that the applicant has to still arrange for the
payment of fees to the Advocate and that after the translation of
papers and on preparation of the appeal his presence is required for
filing affidavit, this application deserves to be partly allowed.
3. In
the result, the application is partly allowed. The applicant is
granted parole leave for further FIFTEEN DAYS
from the date of expiry of earlier parole leave i.e. from 4th
March, 2008, on the same personal bonds. It is made clear that no
further extension of leave will be granted to the applicant and on
completion of the aforesaid period of fifteen days, the applicant
will surrender before the Jail Authority immediately. Rule is made
absolute to the aforesaid extent.
