ORDER
1. Learned Advocate,
Mr. Minesh C. Dave, for the petitioner states that this Court(Coram:
Hon’ble Mr. Justice K.S. Jhaveri) by judgment and order dated
11.08.2010, passed in Special Civil Application No.12769 of 2003,
directed the petitioner therein(G.S.R.T.C.) to grant other subsequent
and consequent benefits.
2. Learned Advocate for
the petitioner, further, submitted that the Court was also pleased to
direct the petitioner to pay the ‘Pensionary’ benefits, since the
petitioner herein, and the respondent in that petition, has already
retired.
3. The above direction
was to be complied within a period of three months, from the date of
the order.
4. Learned Advocate for
the petitioner invited attention of this Court to a communication
dated 16.03.2011 from the respondent-G.S.R.T.C. to the present
petitioner, wherein it is stated that, ‘on perusal of the record it
is found that the petitioner was not a member of the ‘Pension Scheme’
and no contribution was deducted from his salary’.
5. Learned Advocate for
the petitioner states that irrespective of the fact that the
petitioner was not a member of the pension scheme or any contribution
was deducted from his salary towards pension, the direction issued by
this Court is required to be complied with.
6. It is deemed fit
that the Registry be directed to place this matter before the same
Court, after obtaining necessary orders from the Hon’ble the Chief
Justice.
Ordered accordingly.
