Issue notice to the respondents by Registered Post A/D
within a fortnight returnable within six weeks.
The appeal will be heard and the stay of the impugned
award dated 04.10.2008/15.10.2008 passed by Motor
Accident Claims Tribunal, Rampur in MACP No. 80 of 2006
will be operative subject to deposit of the 50 % (fifty percent)
of the total amount awarded by the Tribunal along with
interest accrued thereon till date within a period of one
month from this date. The Tribunal concerned is directed to
release 50 % (fifty percent) of the amount deposited by the
appellant in favour of the claimants without security. In the
event of default in depositing the amount as stated above
within the stipulated period, the interim order shall stand
automatically vacated.
However, the Tribunal concerned is at liberty to keep
remaining/balance 50 % of the amount in a short term Fixed
Deposit of a Nationalized Bank and will be renewed time to
time till the payment is made or till further order/s of this
Court, whichever is applicable. The entire amount will
include the statutory deposit of Rs.25,000/-, which will e
remitted in favour of the concerned Tribunal as expeditiously
as possible.
List immediately after expiry of the aforesaid period.
