ORDER

Rule.

Mr.L.R. Poojari, learned Additional Public Prosecutor waives service
of notice of Rule on behalf of the Respondents.

The
present application has been filed by the applicant-convict through
jail for the grant of temporary bail for a period of 21 days on the
ground of making arrangement for payment of fine, which is Rs.750/-.

The
applicant-convict is convicted in Sessions Case No.185/2001 passed
by the Learned Additional Sessions Judge, Vadodara vide Judgment &
Order dated 27.04.2005 recording the conviction for the offence
under Sections 307 and 324 of the Indian Penal Code and under
Section 135 of the Bombay Police Act.

As
it transpires from the jail remarksheet, the applicant was released
earlier on temporary bail twice and he had absconded for 202 days.
Further, considering the jail remarks and also the fact that the
amount of fine is only Rs.750/-, the grounds do not justify the
entertainment of the present application.

Accordingly,
the present application stands rejected. Rule is discharged.
