3. 19.08.2011 Heard learned counsel for the petitioner as well as learned
Additional Public Prosecutor for the State.
Petitioner is in jail custody since 11.04.2011 in a case registered
under Section 392 of the Indian Penal Code. Petitioner is named in the
First Information Report but as per informant, he came to know about
the name of the petitioner from the mouth of one unknown girl.
It would appear from the perusal of the impugned order that
during the course of investigation, two witnesses claimed to have seen
fleeing the petitioner and co-accused Bablu after the alleged occurrence
having bag in the hand of Bablu.
Learned Additional Public Prosecutor fairly conceded this fact
that except the aforesaid material, nothing has been found by the
Investigating Officer against the petitioner.
Considering the facts and circumstances of the case as well
as submissions of the parties, let the petitioner be released on bail on
furnishing bail bonds of Rs. 10, 000/-(ten thousand) each with two
sureties of the like amount each to the satisfaction of the Chief Judicial
Magistrate, Kaimur at Bhabhua in connection with Durgawati P.s. Case
No. 22 of 2011.
