ORDER

1. This
application has been filed by the present petitioner to release him
on parole leave for a further period of four weeks as his wife is in
her advanced pregnancy stage and is under treatment of Dr.Bakulaben
Joshi. Xerox copy of the certificate issued by Dr. Joshi dated
18.8.2008 is produced by the petitioner. The due date of delivery
according to the certificate is 16.10.2008. The petitioner has been
convicted and sentenced to suffer R.I. for 10 years by the learned
Addl.Sessions Judge, Gondal for the offences under NDPS Act.

2. Taking
into consideration the peculiar circumstances and looking to his past
conduct, this application is partly allowed. The convict-prisoner is
ordered to be released on parole leave for the period of one week
from the date of release, on his furnishing a personal bond in the
sum of Rs.2000/- before the jail authority on condition that he shall
surrender immediately on completion of the parole leave granted to
him. He will also not misuse his liberty during the period of parole
leave. It is made clear that no further extension of parole leave
will be granted to the convict prisoner for the above referred
reason. D.S. permitted.
