11. 6.4.2011. Heard learned counsel appearing on behalf
of the petitioner, learned counsel appearing on
behalf of the Corporation and learned counsel
appearing on behalf of the Provident Fund
Department.
The processes undertaken by the
Corporation and the Provident Fund Department for
disbursement of the pension is not reaching
finality by reason of lapses on the part of the
petitioner herself in not opening the bank account
in the name of her minor son Dheeraj Kumar
Chaudhary enabling the Provident Fund Department
to release the pension amount together with
arrears in the respective accounts.
It is for this purpose that the matter was
adjourned on 23.3.2011 until today enabling the
petitioner to take all such steps for opening the
bank account in favour of her minor son Dheeraj
Kumar Chaudhary.
Mr. Maheshwar Prasad, learned counsel for
the petitioner, submits that despite best efforts,
the petitioner has not yet been able to open the

bank account. He submits that the same would be
opened within a period of next two weeks.
Mr. J.P. Verma, learned counsel appearing
on behalf of the Provident Fund Department,
assures the court that no sooner the bank account
is opened by the petitioner in favour of her minor
son Dheeraj Kumar Chaudhary and due intimation
being given to the Department, necessary steps for
release of the pension amount in favour of the
petitioner and her minor children would be
undertaken within two weeks from the date such
intimation is given by the petitioner.
In view of fair stand taken by the learned
counsel for the Provident Fund Department, this
application stands disposed by reserving liberty
to the petitioner to file a petition for revival
of this contempt application, in case the
Provident Fund Department delays the
implementation of the order despite their
undertaking.
