This petition has been filed by Mandeep Kaur under

Section 439 of the Code of Criminal Procedure for grant of regular

bail in case FIR No. 185 dated 7.12.2006, under Sections 364, 302,

201, 120-B/34 of the Indian Penal Code, registered at Police Station

Bholat, District Kapurthala.

In the present case, FIR in question was lodged by

Sukhdev Singh alleging that his nephew Major Singh was missing

from his house since midnight of 4/5.12.2006. Petitioner-Mandeep

Kaur had lodged a complaint regarding missing of her husband in

Police Station Bholath. The petitioner either in connivance with her

parents/family or with some one else had kidnapped Major Singh with
Criminal Misc. No.M-32381 of 2008 -2-

intention to kill him. Thereafter, during investigation, the petitioner

suffered a disclosure statement that she in connivance with Paramjit

Singh and his associates had committed murder of Major Singh.

Learned counsel for the petitioner has submitted that the

the petitioner is in custody since long and has been falsely involved

in this case.

Learned State counsel, on the other hand, has opposed

this petition and submitted that almost entire prosecution evidence

has been concluded. Only a doctor and Investigating Officer remain

to be examined and the next date fixed before the trial Court is

24.4.2009.

Since in the present case, the entire prosecution evidence

has almost been concluded and only two witnesses remain to be

examined, it would not be appropriate to release the petitioner on

bail.

Keeping in view the seriousness of offence alleged to

have been committed by the petitioner, the effect of her confessional

statement would be seen during trial. The dead body of Major Singh

was recovered after the disclosure statement was suffered by the

petitioner.

Accordingly, this petition is dismissed.
