BY THE COURT:

By way of the instant writ petition, the petitioner has beseeched to quash and set-aside the order dated 3rd December, 2010 issued by the respondent no.2 Superintendent Service Range I, Scheme 10, Vidhyadhar Nagar, Jaipur, whereby an information is found to have been sought as to whether the petitioner has paid the service tax on the amount received by him for providing such service.

From a bare perusal of the impugned order dated 3rd December, 2010, it is found that the same does not give rise to any cause of action to the petitioner in the instant case. By way of the impugned letter, respondent no.2 is found to have simply sought an information from the petitioner as to whether he has paid the service tax on the amount received by him or not. The petitioner is required to reply this letter to the concerned authority, but it does not lead the petitioner to file the writ petition beseeching to quash the same order. The petition is found to be totally frivolous and baseless and the same being bereft of any substance deserves to be dismissed, which stands dismissed accordingly.

Consequent upon the dismissal of writ petition, the stay application, filed therewith, does not survive and that also stands dismissed.
