Heard learned AGA for the State and perused the record.
This transfer application has been filed by the applicant Manish Sharma with
a prayer that the proceedings of S.T. No. 517 of 2000 pending in the court of
II F.T.C., Ghaziabad may be transferred to other Court of neighbouring
district having the competent jurisdiction.
From the perusal of the record, it appears that there is no good ground for
transferring the proceedings of above mentioned case from District-
Ghaziabad to any other adjoining district, such prayer is refused. The interim
order dated 16.9.2005 passed by the another Bench of this Court is hereby
vacated.
Accordingly, this transfer application is dismissed.
Let a copy of this order may be communicated to learned District and
Sessions Judge, Ghaziabad within a week to proceed further in above
mentioned case in accordance with law.
