Heard the learned counsel for the appellant Sri Rajiv Srivastava and Sri Satish
Chandra for respondent nos. 3 and 4.

There is nothing on record to indicate that the appellant was ever appointed in
accordance with the Rules on the post of Assistant Teacher and, of course,
there is no financial approval granted by the District Inspector of Schools at
any point of time nor he has been paid any salary.
That being so, we do not find any illegality in the order passed by the learned
Single Judge.

The special appeal is dismissed.
