A.N.JINDAL, J(ORAL):
This appeal for enhancement is directed against the award dated
07.11.2005, passed by Motor Accident Claims Tribunal, Ropar, awarding
compensation to the tune of Rs.3,38,000/- alongwith interest @ 6% per
annum, on account of the death of Pardeep Bhatia aged about 32 years in a
motor vehicle accident, in favour of the claimants-appellants (herein
referred as ‘the appellants’) and against the respondents jointly and
severally.
Learned counsel for the appellant has offered to settle the
appeal if the compensation is enhanced to Rs.20,000/- over and above the
award amount to which learned counsel for respondent No.3 agrees.
As such, with the consensus arrived at between the parties, this
appeal is partly accepted and the impugned award is modified by enhancing
compensation of Rs.20,000/- over and above the award amount which will
be paid by the respondent-Insurance Company within 45 days on the receipt
of copy of the order, failing which the appellant would be liable to receive
the interest on the enhanced amount at the same rate, as awarded by the
Tribunal.
